Abstract

This study examines the legal regulation of informed consent in Indonesian legislation, focusing on provisions for legally incapacitated individuals and the parameters of medical emergencies as a basis for exempting the obligation to obtain consent. The study aims to assess normative certainty, identify regulatory gaps, and propose the need for detailed implementing technical rules. A normative legal method with statutory and conceptual approaches was employed through literature review and qualitative analysis. The findings indicate that although Law Number 17 of 2023 on Health establishes basic principles of medical consent, it does not specify objective indicators for medical emergencies and legal capacity remains inconsistent across statutes, creating legal gaps and risks of misuse. The study concludes that explicit technical regulations defining emergency parameters and harmonizing capacity criteria are necessary to protect patients and provide legal certainty for healthcare providers.
