Patient safety is a top priority in healthcare and the most important aspect of quality management. One way to implement patient safety is through l;[\
]effective communication between nurses and patients. Communication between nurses and patients is part of nursing which is very important in the provision of health services. The research method uses a normative juridical legal approach derived from google scholar, and PubMed, and those indexed by Sinta and Scopus. The result of this study is that effective communication is needed in the therapeutic agreement relationship between nurses and patients to prevent malpractice. If malpractice occurs, the patient can sue the nurse and hospital through the Criminal Code. To prevent malpractice, nurses can use the SBAR method (situation, background, assessment, and recommendation) in effective communication to patients. The use of this method can minimise the incidence of malpractice and can improve patient safety in hospitals.
